As the operator of the Facebook page, the Gärtnerplatztheater has no interest in collecting and processing the personal data of its visitors. We do not collect data on Facebook for market analysis or marketing purposes. Detailed information on how we handle your personal data can be found in our privacy policy.
The legal basis for the operation of this Facebook page – including the processing of personal data – is based on legitimate interest pursuant to Art. 6 Abs. 1 lit. f. EU-DSGVO.
PROCESSING OF PERSONAL DATA BY FACEBOOK
According to the ruling of the European Court of Justice (ECJ) of 5 June 2018, it was decided that the operator of a Facebook page is jointly responsible with Facebook for the processing of personal data.
The following data is collected from Facebook users:
- Advertising (analysis tools, trackers and personalised advertising)
- Creation and evaluation of user profiles
- Market research and marketing analyses
Facebook Inc. is the American parent company of Facebook Ltd. Ireland and is EU-US Privacy Shield certified. This means that Facebook has committed to complying with and implementing European data protection guidelines. This can be viewed here: https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active
The Staatstheater am Gärtnerplatz has no influence or insight into compliance with these guidelines. We cannot rule out the possibility that user data may be transferred to third countries.
COOKIES BY FACEBOOK
When you visit the Facebook page, Facebook may store information on your computer in the form of cookies. Cookies are small files that are transferred from an internet server to your browser and stored on its hard drive. Only the internet protocol address is stored – no personal data. The information stored in the cookies allows us to automatically recognise you the next time you visit our website, making it easier for you to use. The legal basis for the use of cookies is the legitimate interest pursuant to Art. 6 Abs. 1 lit. f DSGVO.
Of course, you can also visit the Facebook page without accepting cookies. If you do not want your computer to be recognised on your next visit, you can also refuse the use of cookies by changing the settings in your browser to ‘refuse cookies’. You will find the respective procedure in the operating instructions for your browser. However, if you reject the use of cookies, this may result in restrictions in the use of some areas of our website.

STATISTICAL DATA COLLECTION BY FACEBOOK
Facebook provides statistical data via Facebook Insights. This application can help you discover further information about the demographics, location or consumer behaviour of potential customers. Facebook Insights is used to analyse who you have reached with your advertising message. The relevant data can be displayed either for all Facebook users or for the fans of a page, as well as for a defined custom audience. Insights then provide more detailed information on:
- Demographic information: age, gender, relationship status, etc.
- Likes: information provided by fans for other Facebook pages
- Location and language settings of users
- Telephone number
- Activity of selected users
- Proportion of men and women
- Occupations
- Route planner
According to Facebook, all data visible in Insights is aggregated and anonymous for advertisers. Consequently, no conclusions can be drawn about individual persons. The Gärtnerplatztheater's public relations department uses this data in aggregated form to make posts and activities on the page more attractive to each individual user. For example, the distribution by age and gender is evaluated for tailored communication, and the prioritised visiting times of users are evaluated for time-optimised planning of posts on this Facebook page. Information about the type of devices used by visitors helps to adapt the posts in terms of visual design. In accordance with Facebook's terms of use, which every user has agreed to when creating a Facebook profile, we can identify the subscribers and fans of the page and view their profiles and other shared information depending on their privacy settings.
USERS' RIGHTS
Unfortunately, the Staatstheater am Gärtnerplatz cannot fulfil its information obligations under Art. 13 EU-DSGVO, as only Facebook has full access to user data. If you wish to exercise your rights as a data subject, please contact Facebook directly. These rights include:
RIGHT TO INFORMATION
You may request information from us as to whether and to what extent we process your data.
RIGHT TO RECTIFICATION
If we process your data that is incomplete or incorrect, you may request that we correct or complete it at any time.
Right to erasure
You may request that we delete your data if we process it unlawfully or if the processing disproportionately interferes with your legitimate interests. Please note that there may be reasons that prevent immediate deletion, e.g. in the case of statutory retention obligations.
Regardless of whether you exercise your right to deletion, we will delete your data immediately and completely, provided that there are no legal or contractual retention obligations that prevent this.
Right to restriction of processing
You may request that we restrict the processing of your data if
- You dispute the accuracy of the data, for a period that allows us to verify the accuracy of the data.
- the processing of the data is unlawful, but you refuse to have it deleted and instead request a restriction on its use,
- we no longer need the data for the intended purpose, but you still need it to assert or defend legal claims, or
- you have objected to the processing of the data.
Right to data portability
You may request that we provide you with the data you have supplied to us in a structured, commonly used and machine-readable format and that you may transmit this data to another controller without hindrance from us, provided that
- we process this data on the basis of your revocable consent or to fulfil a contract between us, and
- this processing is carried out using automated procedures.
If technically feasible, you may request that we transfer your data directly to another controller.
Right to object
If we process your data on the basis of legitimate interest, you may object to this data processing at any time; this would also apply to profiling based on these provisions. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims. You may object to the processing of your data for direct marketing purposes at any time without giving reasons.
Right to lodge a complaint
If you believe that we are violating German or European data protection law when processing your data, please contact us so that we can clarify any questions. You also have the right to contact the supervisory authority responsible for you, the respective state office for data protection supervision.
If you wish to exercise any of the above rights against us, please contact our data protection officer (for data protection). In case of doubt, we may request additional information to confirm your identity.
If you need assistance or have any other questions, please contact us by email: internetredaktion@gaertnerplatztheater.de. If you no longer wish to have your data processed as described here in future, please use the ‘I no longer like this page’ and/or ‘Unsubscribe from this page’ functions to remove your user profile from our site.
